Insurance is a forward-thinking future loss plan made with the mind of protecting oneself from financial loss which might be occasioned by the loss of property, or life, other such losses which can affect a person’s life, business, finances or well being in other ways. Insurance can further be explained as a kind of preventive risk management plan in which one (the insured ) pays a fee (called a premium) to the insuring party (the insurer, or insurance company) in order to receive a previously agreed payment as compensation in the event of losing (or suffering damage to ) the specific thing that has been insured. This loss or damage must be due to an accident, or any other event in which the insured person or party (alternatively called the policyholder) does not have a fault, or a hand, or is not culpable. The insuring party (the one who promises to pay for the loss) can be the government through an agency, a bank, or any other such appointed financial institution that is licensed by the government to carry out insurance business.

Business, just like every other thing or venture in life, is full of risks. Every place or country or region has certain risks which are more common or more frequently happen in the area, and this peculiarity can arise as a result of the climate, or the topography, or the common occupations, the predominant religion, population, poverty level, crime rate, as well as other factors.

The insurance industry sector in Ontario is regulated by the Insurance Act Law (R.S.O. 1990, c. I.8). The Ministry of Finance is the main regulator of insurance services through the Financial Services Commission of Ontario (FSCO), which is an amalgamation of the former Ontario Insurance Commission, and the Pension Commission and also the Deposit Institutions Division of the Ministry of Finance (of Canada).

In his introduction to the Study Paper written about the Legal Aspects of Long-term Disability Insurance in Canada, author Marvin Baer remarks that “many of the basic laws and principles that regulate the insurance sector are already found in the common law and the legislation tends to be of a piece-meal (settlement )nature.

Baer goes on to say that the insurance sector has no legal obligations that are directly relating to the assessment of risk. The “Unfair Practices” provision which is in the Insurance Act is the only legal deterrent within the system and that the Superintendent of Financial Services would not regularly take action under this provision.

However, the FSCO states that potentially unfair practices are regularly eliminated by agreement through negotiations conducted by FSCO staff with insurance bodies in several departments. Hence holding formal hearings about unfair practices has not been necessary or regular. As a matter of fact it seems that the insurance sector in Ontario has been very fair to policyholders making prompt settlement of claims.

Despite the high investor confidence If you believe that Ontario’s Insurance Act and/or regulations have been contravened by your insurance company, agent, adjuster or anyone else, you may request that the Financial Services Commission of Ontario (FSCO) review the matter. To make a complaint, please complete and submit the Business Activity Complaint Form to the FSCO.

If you wish to make a complaint about an insurance company’s business activity and have been unable to resolve a problem, alternatively you may decide to write to the FSCO and appeal for assistance.

How to File a Complaint

Step 1: Call the company to request a letter from the company’s complaint officer stating the company’s final position on the issue and advising you about the name and details of the independent Ombuds Service that can review the particular complaint. You may need this letter in order to seek further assistance from the authorities.
Turn to the FSCO’s list of company complaint officers

Step 2: Now Write to the independent Ombuds Service referred to you by the insurance company in the company’s final position letter. In Your letter, you should describe your complaint and why you think the insurance company is wrong. Make sure you enclose a copy of the insurance company’s letter and all documentation (premiums and so on) relating to your complaint. This will assist the officer assigned to review your complaint to help you.

It is not usually necessary to hire a lawyer, but, if you already have one, he or she may write the letter to the Ombuds Service for you. If you are writing the letter on behalf of someone else, then please include a note signed by that person, authorizing you to act for him or her. You do not need to be a lawyer to do this. When it is not possible to obtain a signed authorization from the person, please explain the circumstances in writing.

Step 3: The Ombuds Service will then assign a complaints officer to your case to review your unresolved complaint. Your complaint will then be reviewed and an appropriate response provided, outlining the process and telling you what to expect.
